Nomad Nest Participant Terms & Conditions

These Terms and Conditions outline the terms governing your participation in a Nomad Nest program ("Trip") or use of our website, applications, and services (collectively, the "Services"). By agreeing to participate in a Trip or utilizing our Services, you ("Participant," "you," "your") agree to these Terms and Conditions as a binding legal agreement with Nomad Nest Network, LLC ("Nomad Nest," "we," "our," "us").

1. Important Notices

1.1 Acceptance

  • You are at least 21 years old.
  • You have read, understood, and accepted these Terms and Conditions.
  • This agreement is legally binding between you and Nomad Nest.

1.2 Disclaimer

Nomad Nest makes no warranties, either express or implied, regarding any Trip, participation in the Services, or activities offered through the Services. Our responsibilities and liabilities are limited as described in these Terms and Conditions.

1.3 Changes to Terms

Nomad Nest reserves the right to update these Terms and Conditions at any time. We will notify you of changes via email, website notices, or other communication methods. Your continued participation in a Trip or use of our Services after any changes constitutes your acceptance of the updated Terms.

1.4 Privacy Policy

By using our Services, you agree to our Privacy Policy, which outlines how we collect, use, and protect your data.

2. The Services

2.1 General

  • Month-long stays in select cities.
  • Weekend adventures and local experiences.
  • Coworking spaces, accommodations, and community events.

Nomad Nest collaborates with third-party providers ("Other Providers") for services like housing, transportation, and tours. These providers operate independently, and Nomad Nest is not responsible for their actions, services, or liabilities.

2.2 Participant Accounts

You are responsible for safeguarding your account credentials and liable for all activities associated with your account.

2.3 Communications

By providing your contact details, you agree to receive communications from Nomad Nest, including Trip updates, promotional materials, and important notices.

2.4 Assumption of Risk

Nomad Nest cannot guarantee your safety during a Trip. You acknowledge and accept the inherent risks associated with travel.

2.5 Itinerary Changes

We reserve the right to adjust itineraries as needed for Participant safety, comfort, or logistical reasons.

3. Eligibility

3.1 General Requirements

Nomad Nest reserves the right to accept, decline, or remove any Participant from a Trip for reasons including, but not limited to:

  • Behavior causing danger, distress, or inconvenience to others.
  • Failure to comply with payment terms or local laws.

Participants removed from a Trip are not entitled to refunds.

3.2 Documentation

Participants are responsible for securing passports, visas, and any required vaccinations. Failure to do so does not entitle a refund.

3.3 Health and Medical Fitness

Participants must disclose any health conditions that may impact their participation.

4. Payments, Cancellations, and Refunds

4.1 Payment Terms

All payments must be made in accordance with our Payment & Refund Policies, available on our website.

4.2 Cancellations & Refunds

  • Full refunds are available within 24 hours of booking.
  • Cancellations made 90 or more days before the Trip start date may choose:
    • A future trip credit (valid for 365 days), OR
    • A partial refund (minus a 20% cancellation fee and a $100 processing fee).
  • Cancellations made less than 90 days before the Trip start date are non-refundable.
  • No-shows are non-refundable.

5. Health and Safety

5.1 Travel Insurance (Mandatory)

  • All Participants are required to have valid travel insurance covering:
    • Medical expenses & emergencies
    • Evacuation & repatriation
    • Trip cancellation & interruptions
    • Personal liability
  • Proof of insurance may be required before participation.

6. Media and Content

6.1 Media Release

By participating in a Trip, you grant Nomad Nest permission to use your image, video, or likeness for promotional purposes.

6.2 Content Use

Any content you share with Nomad Nest, including photos or testimonials, may be used for marketing purposes.

7. Legal

7.1 Liability Waiver

Nomad Nest is not liable for any injuries, losses, or damages incurred during your participation in a Trip.

7.2 Dispute Resolution

All disputes must be resolved through binding arbitration in Delaware, unless qualifying for small claims court.

7.3 Governing Law

These Terms are governed by the laws of Wyoming, U.S.A.

7.4 Class Action Waiver

All claims must be resolved individually. Class actions are not permitted.

8. Miscellaneous

  • Force Majeure: Nomad Nest is not responsible for events beyond our control.
  • No Weapons Policy: Weapons are prohibited on all Trips.
